This Privacy Notice explains how AP Gas & Electric and our affiliates (collectively, “APG&E,” “we,” “us,” or “our”) collect, use, disclose, and safeguard personal information in connection with our retail electricity and related services, our websites and mobile applications (the “Sites”), and offline interactions.
Scope
This Notice applies to personal information about customers, prospective customers, and visitors to our Sites. It does not apply to APG&E employees, job applicants, or contractors, whose information is covered by separate notices.
Personal Information We Collect
“Personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. The categories of personal information we may collect include:
- Identifiers (e.g., name, postal address, email address, phone number, account identifiers).
- Government ID and other sensitive identifiers (e.g., Social Security number or other government‑issued ID, where necessary for account set‑up, credit checks, or identity verification).
- Customer records (e.g., service address, contract details, account credentials).
- Commercial information (e.g., products or services purchased, considered, or usage histories).
- Energy service information (e.g., energy usage data, meter identifiers, outage or service information, and service location).
- Financial information (e.g., payment card or bank details processed via PCI‑compliant providers).
- Internet or other electronic network activity information (e.g., IP address, device identifiers, log data, analytics, approximate location, and interactions with our Sites and emails).
- Audio/interaction information (e.g., call recordings and language/speech characteristics when you contact customer care, consistent with notice and applicable law).
- Inferences drawn from the above (e.g., preferences or propensity scores used to tailor products or communications).
Sources of Personal Information
- Directly from you (e.g., when you enroll, contact us, or use the Sites).
- Automatically from your browser or device when you access the Sites (e.g., cookies, pixels, tags, session‑replay tools, and other logging technologies).
- From affiliates, utilities/market operators, and service providers (e.g., credit bureaus, identity verification vendors, analytics/advertising partners, and payment processors).
- From publicly available sources and data resellers, where permitted by law.
How We Use Personal Information
- Provide, maintain, and service accounts; process enrollments, billing, and payments; and deliver customer support.
- Operate, secure, debug, and improve our Sites, services, and internal operations (including analytics, quality assurance, and training).
- Personalize content and offers; conduct research and development; and develop new products and services.
- Perform credit checks, identity verification, fraud monitoring, and security incident detection and prevention.
- Comply with legal obligations and exercise or defend legal claims.
- Conduct marketing and advertising, including targeted advertising where permitted by law (see “Your Privacy Choices” below).
Our Disclosures of Personal Information
We disclose personal information for the business purposes described above to:
- Service providers and contractors that process information on our behalf under written contracts (e.g., customer support, payment processing, analytics and advertising, information security, cloud hosting).
- Affiliates within the APG&E family of companies for operational and marketing purposes consistent with this Notice.
- Utilities, market operators, regulators, and other entities as needed to provide energy services and comply with market rules and law.
- Business partners in connection with co‑marketing, promotions, or joint offerings (where permitted and subject to your choices).
- Law enforcement, regulators, and other parties when required or permitted by law, or to protect APG&E, our customers, or the public.
- Parties to corporate transactions (e.g., mergers, acquisitions, financing, or transfer of assets), subject to appropriate safeguards.
Targeted Advertising, Sales, and Sharing
We may use and disclose personal information (including online identifiers and interactions) for targeted advertising. We do not sell personal information for money. Where the use of personal information for targeted advertising or “sharing” (as defined by certain state laws) applies, you may opt out as described in “Your Privacy Choices.”
Your Privacy Rights
Depending on where you live, you may have rights to request: (i) access to and a portable copy of personal information; (ii) correction of inaccuracies; (iii) deletion; and (iv) information about our processing. You may also have the right to opt out of targeted advertising, sales, or certain profiling. We will not discriminate against you for exercising your rights.

Verification: We may need to verify your identity before fulfilling your request. Authorized Agents: You may designate an authorized agent to act on your behalf where permitted by law, subject to verification of the agent’s authority.
Appeals: If we deny your request, you may appeal by contacting appeals@apge.com within 45 days with “Appeal” in the subject line. If your appeal is denied, Texas residents may contact the Texas Attorney General.
Cookies and Similar Technologies
We use cookies, pixels, tags, session‑replay tools, and similar technologies to operate the Sites, understand activity, improve performance, and personalize content and ads. You can manage preferences in our Cookie Settings and via browser/device controls. See our Cookie Policy for details.
Sensitive Personal Information
We may process sensitive personal information (e.g., government identifiers, precise location, or financial details) to provide services, verify identity, prevent fraud, comply with law, or with your consent where required. We do not use sensitive personal information for purposes other than those permitted by applicable law.
Security
We implement reasonable administrative, technical, and physical safeguards appropriate to the nature of the personal information we handle. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Data Retention
We retain personal information only as long as necessary to fulfill the purposes described in this Notice, including to satisfy legal, accounting, or reporting requirements. By way of example: billing and tax records (up to 7 years), customer service recordings (up to 2 years), website logs (90–365 days), and marketing interaction data (up to 2 years), unless a longer period is required by law or to establish, exercise, or defend legal claims.
Children
Our services are not directed to children under 13, and we do not knowingly collect their personal information. If we learn that we have collected personal information from a child under 13, we will delete it.
